Activity: Rank Factors in Determining the Best Interests of the Child

When a child is involved in a separation or a divorce, ultimately the question is “What is in the best interests of the child?” How is this determined? What factors are considered in making a custody decision?

Investigate and rank the factors. Then present your rankings in a written or oral argument.

  1. Visit the Justice Canada Web site to see what factors may be considered in determining the best interests of the child.
  2. According to the Web site, the best interests of the child take priority when custody is being determined. What other issues are considered?
  3. Rank the factors in determining the best interests of the child from most important to least important. Prepare a written or oral argument, in which you justify your rankings.
